1. Conclusion of Contract

1.1. Our product presentation in the INA KOELLN online shop solely represents a non-binding invitation for you to purchase merchandise from us. Our product range is subject to change, as long as the produtcs are not part of a contractual agreement.

1.2. By sending your order, you submit a binding offer to conclude a sales contract with us. The confirmation of the order follows immediately after technically satisfactory receipt of your order.

1.3. We accept your offer by delivering the merchandise. The automatically generated order confirmation e-mail does not constitute acceptance of your offer, it merely documents the fact that we have received your order. We decide at our own discretion whether we will accept an order or not. We will notify you immediately in the event that we do not intend to carry out your order.

1.4 While processing your order, we will inform you by e-mail if we determine that the products you have ordered are not available. No contract is concluded if the merchandise is not available.

1.5 We only sell our merchandise to end consumers who are 18 years of age or older and only in standard commercial quantities.

1.6 The ordering process in our online shop comprises 2 steps. In the first step you select the desired merchandise. The second step allows you to enter the invoice and delivery address and select the desired payment method. When this process is complete you will be able to place your order with us. After you have submitted your order, you will have the opportunity to print it.

2. Voluntary Exchange Option

2.1 Independent of your legal right of revocation, we voluntarily offer you the option of returning products you purchase from us. This allows you to return any items purchased in the INA KOELLN online shop within 14 days of receipt at your own expense, without stating any reasons. The goods must be complete and must be in unused and undamaged condition. You are only permitted to inspect the merchandise in a manner similar to trying it on in a shop. For merchandise affixed with a special hygiene adhesive or a hygienic seal/shrink wrap, this only applies insofar as the adhesive, seal or shrink wrap has not been opened. Generally, goods will only be accepted as long as the label is still attached to the goods.

2.2 Specific further costs incurred by insufficient postage or special shipping (courier services and so on), are the responsibility of the customer.

2.3 The voluntary exchange option does not apply to personalised items or items that are manufactured according to customer specifications.

2.4 Beyond this, the legal right of revocation outlined in section 3 applies.

3. Return Policy

3.1 Right of revocation
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day

a) on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

b) on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good (in the case of a contract relating to multiple goods ordered by the consumer in one order and delivered separately). To exercise the right of withdrawal, you must inform us.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
You can also electronically fill in and submit the model withdrawal form or any other unequivocal statement on our website []. If you use this option, we will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (e.g. by e-mail) without delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

3.2 Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever comes first.
You shall send back the goods or hand them over to INA KOELLN, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

3.3 Model withdrawal form complete and return this form only if you wish to withdraw from the contract.

4. Pricing and Payment methods

4.1 The price specified at time of order applies. All prices include VAT.

4.2 There are several payment options, subject to the conditions specified in the order process. We reserve the right to exclude certain payment methods depending on the result of the verification of your data (identity and credit checks).

4.3 In case of delivery on account, you agree to pay the invoice within 14 days of receipt of goods. In case of prior return of parts delivered this statement may be reduced accordingly.

4.4 If you are in default with the payment, we reserve the right to charge you late fees. In the event of late payment, you agree to reimburse all costs, expenses and disbursements, incurred by us to pursue our claims. This includes, without prejudice to any legal process reimbursement obligation, all extrajudicial costs of a collection agency or designated attorney.

5. Shipping

5.1 The shipping fee within the EU for a purchase above 150€ is without charge. For non EU and worldwide shipping please refer to additional information in “Shipping” in our FAQ. 

5.2 For deliveries outside Europe, further costs may be incurred (customs, any customs fees and import sales tax) on importation into a third country. These other costs are the responsibility of the customer.

5.3 Our delivery takes 3 to 10 business days after the order date, and proper approval of the review of your data (credit and identity verification) provided.

6. Reservation of Title
The merchandise remains our property until it is fully paid.

7. Warranty
Unless express provisions have been made to the contrary, the legal warranty regulations apply.

8. Copyright and Trademark
All of the contents of the website, including text, graphics, photos, images, videos, sounds, illustrations and software are our property or the property of affiliated companies, licensees and/or content providers. This content is protected by copyright and other laws. It may only be used with our expressed consent. All trademarks used on our website are our property unless otherwise stated. They may not be used without our prior written approval.

9. Applicable Law
The laws of the Federal Republic of Germany apply to our contract relationship with you. Excluded from this provision are mandatory safeguards for customers in the country in which you reside. The United Nations Convention on Contracts for the International Sale of Goods is excluded. General place of jurisdiction is Freiburg / Germany
